The Data & Marketing Commission (DMC) is the body which oversees and enforces the Data & Marketing Association (DMA)’s Code.  The Code and DMC give protection to recipients, users and practitioners of the data-driven marketing sector. The DMC aims to ensure companies observe the highest standards of integrity and trade fairly with their customers and with each other. The DMC investigates complaints and identify trends in data-driven marketing that might raise issues for consumers and the sector.

Historically the DMC has adjudicated against complaints about DMA members, but it also expects to become an industry co-regulatory monitoring body following approval of an industry GDPR Code of Conduct by the ICO.  The role of Chief Commissioner will therefore be expanded as the DMC becomes a separately funded independent body responsible for both the compliance and monitoring of companies that sign up to the DMA’s GDPR Code of Conduct and for the investigation of complaints. The DMC has a further extended remit in support of the Advertising Standards Authority (ASA) with complaints by consumers in relation to data and in particular Legitimate Interest and related matters.

The Chief Commissioner must be entirely independent of the data-driven marketing industry and should have a genuine independence of mind and approach.  The Chief Commissioner will be expected to feed back to the DMA Board and Executive, to act as the public face of the DMC and deal with stakeholder relations with the industry and Whitehall. The Chief Commissioner will also ensure that the affairs of the DMC, as a registered company, are properly conducted.

Duties:

The Chief Commissioner will be expected to chair a minimum of four meetings a year held at the DMA’s offices, chair adjudication hearings, and review and process case and other paperwork relating to these meetings, as well as monitor the progress of the DMC’s monitoring body application to the ICO. The Chief Commissioner will keep up to date with issues of the data & marketing industry of relevance to self-regulation.

In addition to formal meetings of the DMC throughout the year, the Chief Commissioner will work closely with the DMC’s Secretariat on complaints to be processed through informal resolution as well as on day-to-day issues of relevance to the DMC.

 

Qualities required:

  • Sound leadership skills, including the ability to chair a mixed board of Independent and Industry Commissioners.
  • Ambassadorial and communications skills particularly the ability to represent the DMC effectively with key industry stakeholders and in Whitehall.
  • Regulation and adjudication skills and the ability to ensure that complaints are managed in an objective and proportionate way.
  • Ability to analyse complex material, identify the key issues and reach sound judgements based on evidence.
  • Independence of mind, ensuring that the DMC operates an independent enforcement function.
  • Strategic awareness particularly the ability to understand developments in the data & marketing industry and the implications for the DMC.
  • Understanding of the principles of good staff and financial management.

  • Location: London
  • Salary (under review): Currently £25,000 p.a. for 24 days (additional days at £1,200 per day)
  • Closing Date:  Midnight Wednesday 1 November 2023
  • Term of appointment: 3 years (renewable) from 1 Jan 2024
